The Fair Pay Restoration Act
Ledbetter v. Goodyear Tire & Rubber
The U.S. Supreme Court case of Ledbetter v. Goodyear Tire & Rubber has had a stifling affect on the ability of employees to recover damages from employers for unequal pay. The Court’s decisions stipulated that Lilly Ledbetter could receive no back pay or damages from her employer. A jury had already established that she was unfairly paid less than her male colleagues for several years. According to the Court, Ledbetter filed her suit too late, citing the beginning of the 180-day deadline from the first check of unequal pay.
The Fair Pay Restoration Act
The act was drafted to address the Ledbetter case so that victims of pay discrimination would have a bigger window to file their complaints. It seeks to eliminate the time limits, allowing those who have suffered unequal pay for equal work to seek back pay and damages when they become aware of the injustice. The Fair Pay Restoration Act has yet to be signed into law.
Equal Pay Act
The Equal Employment Opportunities Commission protects the right of employees to be free from discrimination in their compensation under the Equal Pay Act of 1963. The act requires that men and women be given equal pay for equal work in the same establishment.
