Orange County Labor Attorney

What is the Family Medical Leave Act (FMLA)?

The Family Medical Leave Act (FMLA) of 1993 is a labor law allowing an employee to take unpaid leave due to a new child (adoption, birth, or foster care) or a serious health condition of either the employee or an immediate family member. The bill was signed into law by Bill Clinton and provides workers with 12 weeks of protected, unpaid leave for every 12 months worked. The Act shields workers from termination or demotion because of absence from the job.
