What is a contingency fee?

A contingency fee is only due if a favorable result occurred. It is also known as the “no win no fee” system. They are often used for parties who could not afford lawyer expenses to pursue legal action. The attorney’s fees are paid out of the winnings and damages sum rather than out of the pocket of the client before the case ends. It also provides motivation for an attorney to work thoroughly for the person he or she represents as the salary depends on the outcome of the lawsuit. A downside of contingency fees is “cherry-picking,” where attorneys only select cases that they feel they have a good chance winning, making more complicated and work-intensive cases seem less desirable.
